 Doctor eats entire artichoke, sues restaurant

A Miami doctor has sued Hillstone Restaurant Group, parent of the Houston's chain, after a bad experience with an artichoke. Arturo Carvajal claims suffered distress after eating the vegetable, because he was unfamiliar with artichokes and his server did not instruct him on the proper way to consume it.

The lawsuit alleges negligence and seeks unspecified damages.

In May 2009, Carvajal, who has a family practice in Hollywood, Fla., ate at Houston’s in North Miami Beach. He ordered the grilled artichokes special, which is a vegetable he has “never seen nor heard of previously,” Caravajal claimed in the suit.

The suit alleges that the server “failed to explain the proper method of consuming an artichoke” including that the “outside portion of the leaf should not be eaten; rather, only the inside portion of the leaf was safely digestible.”

Carajal stated that he suffered severe abdominal pain and discomfort, and went to the hospital where an “exploratory laparotomy” revealed artichoke leaves lodged in his bowel. He lists “disability, disfigurement, mental anguish” and “loss of capacity for the enjoyment of life” as a result of eating the entire artichoke.

    • The Doc got what he deserves. He should have grown some balls and inquired on things he was unfamilar with. He is after all an MD. Ask and ye shall recieve....even if it is for instructions and directions. Ask not and ye art a DUMB ARSE. Advise the Doc to either climb into a hole and die or....Go back to what ever place he crawled out from to America. I bet you cash Dumb Ass Doc would know better in his own country.

    • Seems to me the real problem with our judicial system is courts (judges) that provide any merit to such cases. A judge ought to have the "testicular fortitude" to throw such silliness out of their courtrooms and attend to real problems. Permitting such cases to proceed only encourages the next guy to sue because "my ice water was too cold" or some other equally hairbrained thing. As my father, an attorney and graduate of Cornell Law School used to say "If they elected judges on the basis of merit, there wouldn't be any"

    • One more immigrant who came to America, educated, living the good life. I can't imagine why he doesn't know what an artichoke is, or ordered it if he had no clue. Was he alone? Couldn't he ask someone? He may be educated but he's stupid, or was he just looking for an easy target?

    • OMG, I wouldn't want to be his patient. He must treat his patients without asking any questions; just looks and figures out what is wrong and dives right in. It's just like eating an artichoke.

    • He's a doctor....one who attends to you when you need help for an illness or accident....and he's this stupid...???? Makes you wonder how hard medical school really is.....and in whose hands you place your life in the event of a medical emergency. Or.....he's smart enough to work the system and get a big settlement and not have to work....like a whole lot of other creeps in the world.
